Flashrecall Terms of Use

Welcome to Flashrecall, an app developed by TMBC Pte Ltd ("we," "us," or "our"). These Terms of Use ("Terms") explain the rules you agree to follow when using the Flashrecall app and services.

By using Flashrecall, you agree to these Terms. If you do not agree, please do not use the app.

1. Who Can Use Flashrecall

• You must be at least 18 years old to use Flashrecall.
• If you are 16 or 17 years old, you may only use the app with parental or guardian consent.
• You may not use the app if you are under 16.

2. Your Account

• You must provide accurate information when creating your account.
• You are responsible for keeping your login details secure.
• You are responsible for all activity under your account.

3. Acceptable Use

When using Flashrecall, you agree not to:

• Break any laws.
• Upload harmful or illegal content.
• Try to hack, disrupt, or overload the app.
• Reverse-engineer or copy our code or services.
• Use the app in a way that harms others or violates their rights.

4. Paid Features

• Some features may require payment.
• Payments are processed securely using third-party services.
• All sales are final unless required by law.

5. Subscription Terms

Flashrecall offers subscription plans with weekly, monthly, and yearly billing periods. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

We provide a free trial period for new subscribers:

• 3 days for the weekly plan
• 7 days for the monthly and yearly plans

You can manage or cancel your subscription anytime through your Apple ID account settings. For detailed instructions, visit Apple's subscription management support page.

Please note, we currently do not notify users in advance of price changes.

Refunds are not provided, as users retain access to paid features until the end of their current subscription period. Refunds are handled by Apple according to their policies.

6. Intellectual Property

• Flashrecall and all related content (logos, code, designs) are owned by TMBC Pte Ltd.
• You may not use our content or name without permission.
• You own the flashcards and content you create, but we may process it through services like OpenAI to provide features.

7. Use of AI and Third-Party Services

• Flashrecall uses OpenAI to generate and process flashcard content.
• OpenAI may store and use data as per OpenAI's Privacy Policy.
• We also use trusted services like Supabase and Branch MMP to help us understand how people use the app.

8. Data and Privacy

Your personal data is handled as described in our Privacy Policy. In short:

• We collect basic info (like name and email), device usage data, and payment info.
• We do not store your uploaded content (audio, images, PDFs, videos).
• We don't sell your data.
• You can contact us to access or delete your data.

9. Account Termination

We may suspend or delete your account if you:

• Break these Terms,
• Abuse the app or our systems,
• Violate laws or harm others.

You may also delete your account at any time by contacting us.

10. Disclaimer

Flashrecall is provided "as is." We do our best to keep it reliable, but we cannot guarantee it will always work without errors or interruptions.

10.1 AI-Generated Content and Academic Results Disclaimer

Flashrecall uses AI (such as OpenAI) to help generate flashcards and learning materials. While we do our best to ensure the quality and accuracy of this content, AI can make mistakes. The content generated may not always be accurate, complete, or up-to-date. You are responsible for verifying any important information before using it, especially for school, work, or decision-making.

Additionally, we do not guarantee any specific results, grades, or outcomes from using the app. Flashrecall is a study tool, and your performance depends on many factors beyond our control, such as your effort, understanding of the material, and how you use the app.

We are not responsible for any academic performance issues, exam results, or other consequences that may arise from relying on the content provided.

11. Limitation of Liability

We are not responsible for:

• Any loss of data or content,
• Any damages from using or not being able to use the app,
• Any issues caused by third-party services (like OpenAI or Supabase).
• Any inaccuracies in AI-generated content, even if used for studying, learning, or decision-making,
• Your academic performance, grades, exam results, or any outcomes resulting from your use of Flashrecall.

12. Changes to These Terms

We may update these Terms from time to time. If we make major changes, we'll let you know in the app or by email. Continued use after changes means you agree to the new Terms.
